What is the Limited Warranty?

LIMITED WARRANTY

Digital Treasures warrants this product to be free from defects in materials and workmanship for a period of one year from the date of purchase.. This warranty covers the original purchaser only, and is not transferable to anyone who subsequently buys, leases, or otherwise obtains from you. Your original purchase invoice or sales receipt, showing date of purchase, is your proof for warranty claims and for establishing the warranty period. The duration of this warranty does not extend beyond the initial one-year period of coverage should any repairs or replacements be made or performed during the warranty period. This warranty does not extend to any product not purchased from Digital Treasures, Inc., or an authorized Digital Treasures reseller. This warranty does not extend to product that has been damaged or rendered defective as a result of use for which the product is not intended, is contrary to instructions provided in the user guide, as a result of the use of parts not manufactured or sold by Digital Treasures, or due to any misuse, abuse, negligence, modification, or improper packing when returning product to Digital Treasures. EXCEPT FOR THE WARRANTY SET FORTH HEREIN, DIGITAL TREASURES DISCLAIMS ALL OTHER WARRANTIES, EXPRESSED OR IMPLIED OR STATUTORY, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. ANY IMPLIED WARRANTIES THAT MAY BE IMPOSED BY APPLICABLE LAW ARE LIMITED TO THE TERM OF THIS WARRANTY. IN NO EVENT SHALL DIGITAL TREASURES, INC. BE LIABLE FOR ANY INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF BUSINESS, PROFITS, DATA OR USE, WHETHER IN AN ACTION IN CONTRACT OR TORT OR BASED ON A WARRANTY, ARISING OUT OF OR IN CONNECTION WITH THE USE OR PERFORMANCE OF THE PRODUCT. YOU AGREE THAT REPAIR, AND (UPON AVAILABILITY) REPLACEMENT, AS APPLICABLE, UNDER THE WARRANTY SERVICES DESCRIBED HEREIN IS YOUR SOLE AND EXCLUSIVE REMEDY WITH RESPECT TO ANY BREACH OF THE DIGITAL TREASURES, INC. LIMITED WARRANTY SET FORTH HEREIN.

We promise that your TurtleCell product will be defect-free in materials and workmanship. No warranty, expressed or implied, is made regarding any product’s merchantability or fitness for a particular purpose.

Are there any exclusions or limitations?

This warranty does not extend to any product not purchased from Digital Treasures, Inc., or an authorized Digital Treasures reseller. This warranty does not extend to product that has been damaged or rendered defective as a result of use for which the product is not intended, is contrary to instructions provided in the user guide, as a result of the use of parts not manufactured or sold by Digital Treasures, or due to any misuse, abuse, negligence, modification, or improper packing when returning product to Digital Treasures.

By purchasing a TurtleCell, whether you place your order online or by telephone, you acknowledge that you have had an opportunity to review TurtleCell’s warranty terms, have done so to the degree needed to be familiar with them, and you accept their terms and conditions, including the limitations, exclusions, and disclaimers in them. Some state laws do not allow limitations on implied warranties or the exclusion or limitation of certain damages. If these laws apply to you, some or all of the disclaimers, exclusions or limitations may not apply to you, and you might have additional rights.

The warranty will not cover any defect or malfunction that is caused as a result of misuse, neglect, accident, improper handling, abnormal physical stress, abnormal environmental conditions, failure to follow operating instructions, abuse, or use with improper or faulty equipment. It does not cover incidental damages.

Additionally, the warranty will no longer be effective if:

  • you open any product or part of a product that is not intended to be opened;
  • the product has been reconstructed, repaired, or altered by any person other than TurtleCell or its authorized representative; or
  • if the product has been used with any third-party product, hardware, or product that has not been previously approved by TurtleCell.

Please do not try to fix anything yourself. TurtleCell does not warranty or provide service or support for any third party products.

Do I need any documentation to make a warranty claim?

To help ensure warranty claims are for genuine TurtleCell products, our technical support department may require a receipt to complete your claim. If a receipt is required, you will be emailed requesting a copy be attached and sent to us via email at warranty+turtlecell@digitaltreasures.com

Does the Limited Warranty apply to third-party products sold by TurtleCell?

Products sold through the TurtleCell Online Store that do not bear the TurtleCell brand name are serviced and supported exclusively by their manufacturers in accordance with any terms and conditions packaged with the products (unless the third-party product is pre-installed in an TurtleCell-branded product). TurtleCell Limited Warranty does not apply to products that are not TurtleCell-branded, even if packaged or sold with TurtleCell products. Please contact the manufacturer directly for technical support and customer service.

How Do I MAKE Warranty CLAIM?

If you require warranty service, email warranty+turtlecell@digitaltreasures.com or contact Digital Treasures, Inc. directly at (248) 236-0061 to report a claim, at which time Digital Treasures technicians will attempt to solve any issues. If we are unable to resolve your issue, you will be issued a Return Merchandise Authorization (RMA) to authorize the return of the item for repair/replacement. All charges incurred while returning product, including postage, duties, export taxes, and customs duties, are the responsibility of purchaser, and purchaser assumes all risk of loss during shipment.
